SRAN LAW OFFICE Privacy Policy

SRAN LAW OFFICE is a firm that specifically handles Criminal Law, Personal Injury, Civil Law, Family Law and Immigration Appeal matters with our office located at 285 Steeles Avenue West, Brampton, Ontario, L6Y 0B5, Canada. The Lawyers and staff of SRAN LAW OFFICE (sometimes hereinafter referred to as "we") understand the importance of privacy and the sensitivity of personal information. As lawyers we have a professional obligation to keep all information we receive confidential within a Solicitor-Client relationship. We are committed to protecting any personal information we hold. This Privacy Policy outlines how the Lawyers and other staff members at SRAN LAW OFFICE are committed to managing your personal information and protecting your privacy.

Privacy Legislation

From January 1st 2004, all businesses engaged in commercial activities must comply with the Personal Information Protection and Electronic Documents Act ("PIPEDA") and the Canadian Standards Association Model Code for the Protection of Personal Information, which it incorporates. These obligations extend to lawyers and law firms, including SRAN LAW OFFICE. The Act gives you rights concerning the privacy of your personal information.

As a professional service firm, SRAN LAW OFFICE is responsible for the personal information we collect and hold. To ensure this accountability, we have developed this policy, and trained our Lawyers and staff members about our policies and practices to keep confidential the information we receive in the context of a Solicitor-Client relationship.

Personal Information

Personal Information, under PIPEDA, is defined as information about an identifiable individual, but does not include the name, title, or business address or telephone number of an employee of an organization. In other words, it does not include the information that one expects to find advertised in any manner in the public.

SRAN LAW OFFICE needs the personal information to provide appropriate legal services and products to a wide range of clients. If we did not collect and use your personal information, we could not provide you with legal services.

How do we collect your personal information?

We collect information only by lawful and fair means, and not in an unreasonably intrusive way. Wherever possible we collect your personal information directly from you, both at the start of a retainer and during the course of your retainer with SRAN LAW OFFICE.

Sometimes we may obtain information about you from other sources, for example:

Consent

In most cases, we obtain your consent to collect, use, or disclose your personal information. Normally, we ask for your consent in writing, but in some circumstances, we may accept your oral consent. Usually, if you retain our firm, we assume that we have your implied consent to our collection and use of your personal information, however, at times we may ask for your express consent, either verbally or in writing. Sometimes, your consent may be implied through your conduct with us.

Use of Your Information at SRAN LAW OFFICE

We use your personal information to provide legal advice and services to you, to administer our clients (invoice and client databases), and to include you in any direct marketing activities. If you wish to no longer receive information about our services or about new developments in the law, we will not send any further material.

SRAN LAW OFFICE does not disclose your personal information to any third party to enable them to market their products and services. For example, we do not provide our client mailing lists to other law firms.

Disclosure of your Personal Information

Generally, we do not disclose your personal information to third parties without your consent. However, SRAN LAW OFFICE will disclose your personal information under certain circumstances, such as:

Updating Your Information

Since we use your personal information to provide legal services to you, it is important that the information we have on file be accurate and up-to-date.

If any of your information changes during the course of the retainer, please inform us immediately so we may update our databases. Sometimes, we may call to ask and confirm if all information is up-to-date.

Is My Personal Information Secure?

SRAN LAW OFFICE takes all reasonable precautions/safeguards to ensure that your personal information is kept safe from loss, theft, unauthorized access, copying, modification, or disclosure. Among the steps taken to protect your information are:

Access to Your Personal Information

SRAN LAW OFFICE does not use your Social Insurance Number (SIN) as a way of identifying or organizing the information we hold upon you.

You may ask for access to any personal information we hold about you and have the right to ensure its accuracy and completeness, and to have it amended, if appropriate.

Summary information is available on request. More detailed requests which require archive or other retrieval costs may be subject to our normal professional and disbursement fees.

You may also request a summary report about how that information is used and disclosed, subject to certain exceptions prescribed by law.

Access to your personal information may be denied when:

If your request for access is denied, SRAN LAW OFFICE will notify you in writing of the reason for the denial. Once again, such a detailed summary has retrieval costs subject to our normal professional and disbursement fees.

Can I request anonymity?

Whenever it is legal and practicable, we may offer the opportunity to deal with general inquiries without providing your name (for example, by accessing general information on our website). The Proceeds of Crime (Money Laundering) and Terrorist Financing Act requires us to confirm the identity of all new clients. It may also require us to disclose information to FINTRAC in relation to certain large cash transactions.

Credit Bureaus

To help us make credit decisions about clients, prevent fraud, check the identity of new clients and prevent money-laundering, we may – with your consent – request information about you from the files of consumer reporting agencies.

Communicating with Us

When contacting us to send personal or confidential information, you should be aware that e-mail is not a 100% secure medium and should contact our office and speak directly with a Lawyer or staff member of SRAN LAW OFFICE.

Employment Inquiries

If you apply for a position within SRAN LAW OFFICE, we will use your personal information to assess your candidacy. We may use your contact information (name, e-mail, contact information and postal address) so that we may communicate with you about recent developments in the law or firm, keep you abreast of SRAN LAW OFFICE news, and invite you to our firm events.

We normally retain information from candidates after a decision has been made, unless you ask us not to retain the information. If we offer you a job, which you accept, the information will be retained in accordance with our privacy procedures for employee records.

SRAN LAW OFFICE will respond to inquiries about its policies and practices relating to its handling of your personal information. Inquiries should be directed to SRAN LAW OFFICE using the contact information below. SRAN LAW OFFICE will investigate all complaints and will respond within 30 days of receipt of a written inquiry.
